Terms of Use

These terms are an agreement between you and Jordan Bentley, who operates the Gourdgeous app ("Gourdgeous," "we," "us"). By using the app, you agree to these terms and to our Privacy Policy.

Who can use Gourdgeous

You must be at least 13 years old. If you're under 18, you need a parent or guardian's permission. You sign in with Apple, and you're responsible for activity on your account.

What the app does

Gourdgeous creates pumpkin carving stencils with AI from a photo of your pumpkin and a short idea, turns your own photos into stencils ("traces"), and offers stencils drawn by independent artists in the Shop. AI designs are generated automatically, so results vary and may not always match your idea or carve perfectly. Please check a design before you cut.

Free designs and passes

• Free allowance: each Apple account gets a small number of free AI designs and free traces per season. Deleting and re-creating your account doesn't reset them.
• Passes are one-time purchases, not subscriptions. They never renew or charge you again.
• Pumpkin Pass and Great Pumpkin Pass add a set number of AI designs (used for pumpkin designs or traces after your free ones) and unlock every stencil in the 2026 Shop.
• Single Stencil unlocks one specific Shop stencil.
• All 2026 purchases are valid through November 30, 2026. Unused designs expire after that date.
• A design is counted only when a stencil is successfully made. Rejected photos, rejected requests and errors don't use one up.
• Payments and refunds are handled by Apple. To request a refund, visit reportaproblem.apple.com.
• Purchases are tied to your Gourdgeous account. If you delete your account, any remaining designs and unlocks are lost.

Keep it spooky, not inappropriate

Classic Halloween horror is welcome: monsters, skulls, zombies, ghosts and gore. You agree not to use Gourdgeous to:

• Request or upload sexual content, or anything that sexualizes minors.
• Promote hate against people based on who they are.
• Depict real, named people being harmed, or harass anyone.
• Upload photos of people without their permission.
• Request designs that copy characters, logos or artwork you don't have the rights to.
• Get around limits, for example with automated requests, multiple accounts or tampering with the app.

Requests and photos are checked automatically. If someone repeatedly breaks these rules or sends unusable requests, designs may be paused for a period of time, and repeated or serious misuse can result in a longer restriction or account termination.

Your photos and designs

• Your photos and ideas stay yours. You give us permission to process them only to create your designs and run the app.
• Your AI designs are yours to use. You may carve, print and share the designs Gourdgeous makes for you. Because they're made by AI, other people may get similar results, and AI-generated images may not be eligible for copyright protection.
• Featuring designs: you give us a non-exclusive, worldwide, royalty-free license to display, copy and feature the AI pumpkin designs you create (not your photos, and not designs traced from your photos) inside Gourdgeous and in our marketing, for example in a featured collection. We won't show your name or account when we do.

Shop stencils

Shop stencils are created by independent artists and licensed to us. When you unlock one, you get a personal, non-commercial license to print it and carve it on your own pumpkins and to share photos of your carving. You may not resell, redistribute or upload the stencil files themselves, or use them for commercial products.

Original and Popular badges

Badges are just for fun. They have no cash value, can't be transferred, and may be adjusted, reset each season or discontinued.

Carving safety

Pumpkin carving involves sharp tools and sometimes open flames. Use proper carving tools, cut away from yourself, supervise children, and never leave candles unattended. You're responsible for how you carve and light your pumpkin, and Gourdgeous isn't responsible for injuries or damage.

Our app and content

The Gourdgeous app, name, logo, artwork and software belong to us or our licensors. Except for the rights described above, these terms don't give you any rights to them.

Disclaimers

Gourdgeous is provided "as is" and "as available." To the extent the law allows, we don't promise that the app will be uninterrupted or error-free, that every design will be carvable, or that designs will meet your expectations.

Limitation of liability

To the extent the law allows, we won't be liable for indirect, incidental or consequential damages, and our total liability for any claim related to Gourdgeous is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you, and nothing here limits rights you have under consumer protection laws that can't be waived.

Changes and ending use

We may update the app or these terms. If we make meaningful changes to the terms, we'll update the date above and, where appropriate, let you know in the app. You can stop using Gourdgeous and delete your account anytime. We may suspend or end access for anyone who breaks these terms.

Apple

These terms are between you and us, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide maintenance or support, and isn't responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property claims. If the app fails to meet an applicable warranty, you can notify Apple, which may refund the purchase price, and Apple has no other warranty obligation for the app. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited parties. You must follow any applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of Washington State, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Washington State, unless the law where you live gives you the right to bring a claim in your local courts.
